Ex Parte Order in the Fall of 2012

Via an original Ex Parte Order in the Fall of 2012, we obtained an emergency change of custody of a minor child from her biological mother to our client on a temporary basis; this matter was tried to its conclusion in June 2013. During the trial Fred Erben successfully proved that changing physical care, custody, and control from the former wife will materially promote the welfare and best interests of our client’s minor child. This trial resulted in a July 2013 Order issued by the Jefferson County Alabama Domestic Relations Court modifying the parties’ divorce agreement and awarding custody of the minor child to our client, along with the relevant change in child support. The change was so drastic, the biological mother can have NO CONTACT with the child, either in person, through social media, or phone, until further order of the Court.
